Proposal to amend Chapter 18.61, Hillside Development Overlay Zone, of the Pima County in order to: 1) add, delete or revise the provisions of section 18.61.010 (Purpose), 18.61.020 (Scope and Exceptions), 18.61.030 (Definitions), 18.61.040 (Prohibited Uses), 18.61.050 (Protected Peaks and Ridges), 18.61.060 (Natural Areas), 18.61.070 (Slope Density Requirements), 18.61.080 (Development Standards), 18.61.090 (Platting and Development Plan Requirements/Review/Compliance), 18.61.100 (Variances/Special Use Permits), 18.61.110 (Illustrations), and 18.61.120 (Maps); 2) increase the horizontal radius of the prohibition of development for a protected peak or ridge (section 18.61.050) from 150 feet to 300 feet, as measured from the protected peak point or ridge line; 3) designate as protected those peaks or ridges that are located within eastern unincorporated Pima County (bounded on the north by Pinal County, on the east by Graham and Cochise counties, on the south by Santa Cruz County and the United States-Mexico International Boundary Line, and on the west by the Tohono O'Odham Indian Reservation); and Proposal to amend, as necessary and related to the proposed amendment of Chapter 18.61, the following chapters of the Pima County Zoning Code: 18.03 (General Definitions), 18.05 (Zones, Maps and Boundaries), 18.67 (Buffer Overlay Zone), 18.81 (Grading Standards), 18.89 (Comprehensive Plan), and 18.99 (Review Committees). Proposal to amend Chapter 18.67, Buffer Overlay Zone, of the Pima County Zoning Code in order to: 1) add, delete or revise the provisions of sections 18.67.010 (Purpose), 18.67.020 (Definitions), 18.67.030 (Applicability), 18.67.040 (Critical and Sensitive Biological Communities Maps), 18.67.050 (Performance Standards), 18.67.060 (Exceptions to Performance Standards), and 18.67.070 (Rezoning and Specific Plan Procedural Requirements); 2) apply the Buffer Overlay Zone to all land parcels of 3.3 acres and greater presently subject to the Buffer Overlay Zone only at the time of rezoning; 3) expand the applicability of the Buffer Overlay Zone to all land parcels of 3.3 acres and greater presently exempted in section 18.67.030.B; 4) expand the applicability of the Buffer Overlay Zone to all land parcels of 3.3. acres and greater within one mile of the present boundaries of the Tortolita Mountain Park, Saguaro National Park (east and west units), and Tucson Mountain County Park; 5) designate as public preserves the Cienega Creek Preservation Area, Colossal Cave Mountain Park, Coronado National Forest (Whetstone Mountains unit), Empire/Cienega Resource Conservation Area, Santa Rita Experimental Range and Wildlife Area, Coronado National Forest (Tumacacori Mountains and San Luis Mountains unit), Buenos Aires National Wildlife Refuge, Organ Pipe Cactus National Monument, and Cabeza Prieta National Wildlife Refuge; and 6) expand the applicability of the Buffer Overlay Zone to all land parcels of 3.3 acres and greater within one mile of the above proposed public preserves. *13. Co8-98-08, RIPARIAN HABITAT ORDINANCE REVISIONS (CHAPTERS 18.07/16.54)
An ordinance of the Board of Supervisors of Pima County, Arizona; relating to zoning; amending the Pima County Code by amending section 18.07.080, (sections a & e, applicability and mitigation) to revise the applicability of the Watercourse and Riparian Habitat Protection and Mitigation Ordinance and revise the mitigation requirements. The Board of Supervisors is proposing to amend two sections of the Pima County Code; 1) Title 16, Floodplain and Erosion Hazard Management, Chapter 16.54, Watercourse and Riparian Habitat Protection and Mitigation Requirements; and 2) Section 18.07.080 (Modification of Development Standards in Riparian Areas) of the Zoning Code, to encourage safer development within floodplain areas of unincorporated Pima County. The two sections of the Code function as companion ordinances. Section 18.07.080 must be amended to include proposed changes to the mitigation requirements and applicability of Article X of Chapter 16.54 of the Pima County Code. Staff recommends APPROVAL. 14. Co8-98-07, GOLF COURSE IRRIGATION ORDINANCE REQUIREMENTS (CHAPTER 18.59)
An ordinance of the Board of Supervisors of Pima County, Arizona; relating to zoning; amending the Pima County Zoning Code by amending Chapter 18.59 to require groundwater replenishment when renewable water supplies are not used for golf course irrigation, and to require such replenishment to occur within the Pima County portion of the Tucson Active Management Area. On motion, the Planning and Zoning Commission voted 7 - 0 (Commissioners Grijalva, Hausman, and Marcke were absent) to recommend APPROVAL. Staff recommends APPROVAL. (All Districts)
